Concertium LLC is a performance-driven media buying agency that helps growth-stage companies, startups, and established organizations scale their customer acquisition through data-driven advertising strategies. Our SMS services are governed by the Telephone Consumer Protection Act (TCPA) and related regulations.
When you opt in to receive SMS messages from ShieldWatch, you agree to receive recurring promotional and transactional text messages. Message and data rates may apply. SECTION 2 — Use of Services
Concertium LLC and its services are intended for use by adults only. Concertium LLC DOES NOT WARRANT THAT THE WEBSITE OR SERVICES WILL BE ERROR-FREE, UNINTERRUPTED, SECURE, OR MEET YOUR REQUIREMENTS. TO THE MAXIMUM EXTENT PERMITTED BY LAW, Concertium LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, GOODWILL, DATA, OR OTHER INTANGIBLE LOSSES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
YOUR SOLE AND EXCLUSIVE REMEDY FOR ANY DISPUTE WITH Concertium LLC SHALL BE LIMITED TO THE AMOUNT YOU PAID FOR THE SERVICES IN QUESTION, OR IF NO PAYMENT WAS MADE, $100. Carriers are not liable for delayed or undelivered messages.
SECTION 6 — Indemnification
You agree to indemnify, defend, and hold harmless Concertium LLC, its officers, directors, employees, and agents from and against any and all claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of or relating to:
Your use of the website or services in violation of these Terms
Your violation of any applicable laws or regulations
Your infringement of any third-party rights
Any content you submit to our website
Your conduct in connection with ShieldWatch's services
SECTION 7 — Cancellation and Refund Policy
All sales are final. Concertium LLC does not offer refunds for services rendered or access purchased. However, if you are not satisfied with your purchase, you may cancel your subscription at any time by contacting us at [email protected] or +1 (813) 774-1672.
If you believe you are entitled to a refund due to a billing error or unauthorized charge, please contact us immediately with documentation supporting your claim. We will investigate and respond within 30 days.
SECTION 8 — Payment Terms and Billing
By providing payment information, you authorize Concertium LLC to charge your payment method for the services and fees you select. We may charge your payment method automatically on each billing date. Failure to use available services does not relieve you of your payment obligations. You may cancel your subscription at any time in accordance with Section 7.
SECTION 9 — Your Responsibilities
You represent and warrant that you operate a business in good standing and that there are no prior or pending government investigations or prosecutions against you or your business. You agree to use ShieldWatch's services only for lawful purposes and in compliance with all applicable laws and regulations, including but not limited to laws governing advertising, marketing claims, email marketing (CAN-SPAM Act), and telemarketing (TCPA and FTC Telemarketing Sales Rule).
You are solely responsible for compliance with all laws applicable to your business. Concertium LLC does not provide legal, tax, accounting, or financial advice. You should consult qualified professionals for advice on those topics.
SECTION 10 — Testimonials and Customer Success
Any testimonials or case studies provided on our website represent individual experiences and are not guarantees of success. Results may vary based on individual circumstances, effort, business model, market conditions, and other factors. We do not claim responsibility for specific business outcomes.
SECTION 11 — Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of Florida, without regard to its conflict of law principles. Any dispute arising out of or related to these Terms or your use of our website or services shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association (AAA).
The arbitration shall be conducted before a single arbitrator in Florida, or via telephonic or video conference. Each party shall bear its own attorney's fees and costs, and the parties shall split the arbitrator's fees and administrative costs equally. Notwithstanding the foregoing, either party may pursue injunctive relief in court to prevent misuse of intellectual property or breach of confidentiality obligations.
SECTION 12 — Class Action Waiver
YOU AND Concertium LLC AGREE THAT ANY DISPUTE SHALL BE RESOLVED ON AN INDIVIDUAL BASIS AND NOT AS A CLASS ACTION, CLASS ARBITRATION, OR REPRESENTATIVE ACTION. YOU WAIVE YOUR RIGHT TO PARTICIPATE IN CLASS ACTIONS OR CLASS ARBITRATIONS AGAINST Concertium LLC.
SECTION 13 — Severability
If any provision of these Terms is found to be invalid or unenforceable, that provision shall be modified to the minimum extent necessary to make it valid and enforceable, or if such modification is not possible, the provision shall be severed. The remaining provisions shall remain in full force and effect.
SECTION 14 — Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Concertium LLC regarding your use of our website and services and supersede all prior negotiations, understandings, and agreements, whether written or oral.
